These Terms of Use (hereinafter referred to as "these Terms") set forth the conditions for using the services provided by REALIZE LLC (hereinafter referred to as "the Company") on this website (hereinafter referred to as "the Service").
Customers must comply with these Terms when using the Service.
These Terms shall apply to all relationships concerning the use of the Service between the Customer and the Company.
User registration shall be completed when an applicant applies for registration by the method prescribed by the Company and the Company approves the application.
The Company may refuse to approve a registration application if it determines any of the following reasons apply to the applicant, and the Company shall have no obligation to disclose the reasons.
(1) If false information is provided in the registration application.
(2) If the applicant has previously violated these Terms.
(3) If the Company otherwise judges that the registration is inappropriate.
Customers shall manage their Customer ID and password for the Service at their own responsibility.
Customers shall not transfer or lend their Customer ID and password to any third party under any circumstances. The Company shall regard any login with a Customer ID and password combination matching the registered information as use by the registered Customer themselves.
Customers shall pay the usage fees separately determined and displayed on this website as consideration for using the Service, by the method designated by the Company.
Customers shall not engage in the following acts when using the Service.
(1) Acts that violate laws or public order and morals.
(2) Acts related to criminal activities.
(3) Acts that destroy or interfere with the functions of the Company's servers or networks.
(4) Acts that may interfere with the operation of the Company's services.
(5) Acts of collecting or accumulating personal information of other customers.
(6) Acts of impersonating other customers.
(7) Acts of directly or indirectly providing benefits to antisocial forces in connection with the Company's services.
(8) Other acts that the Company deems inappropriate.
The Company may suspend or interrupt all or part of the Service without prior notice to the Customer if it determines any of the following reasons apply.
(1) When performing maintenance, inspection, or updates of the computer system related to the Service.
(2) When it becomes difficult to provide the Service due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters.
(3) When computers or communication lines are stopped due to accidents.
(4) When the Company otherwise judges that it is difficult to provide the Service.
The Company shall not be liable for any disadvantages or damages incurred by the Customer or third parties due to suspension or interruption of the Service, regardless of the reason.
The Company may restrict the use of all or part of the Service or delete the Customer's registration without prior notice in the following cases.
(1) When any provision of these Terms is violated.
(2) When it is found that there is false information in the registration details.
(3) When the Company otherwise judges that the use of the Service is inappropriate.
The Company shall not be liable for any damages incurred by the Customer due to actions taken under this Article.
The Company shall be exempt from liability for non-performance unless caused by the Company's intentional or gross negligence.
Even if the Company is liable for any reason, compensation shall be limited to the range of ordinary damages and, for paid services, shall not exceed the amount paid (or the equivalent of one month's fee for continuous services).
The Company shall not be responsible for any transactions, communications, or disputes arising between Customers or between Customers and third parties in connection with the Service.
The Company may change the content of the Service or discontinue the Service without notifying Customers, and shall not be liable for any damages caused to Customers as a result.
The Company may change these Terms at any time without notifying Customers if deemed necessary.
Notices or communications between Customers and the Company shall be conducted by the methods prescribed by the Company.
Customers shall not transfer or pledge their position under the usage contract or any rights or obligations under these Terms to any third party without prior written consent from the Company.
These Terms shall be governed by Japanese law.
In the event of any dispute concerning the Service, the court having jurisdiction over the location of the Company's head office shall have exclusive jurisdiction.
